Auf die Frage: "Was ist Schönheit" oder "Was ist das Schöne" antwortet Hegel mit seiner oft zitierten Formel, das Schöne sei das "Sinnliche Scheinen der Idee". Idee ist hier letztlich das Absolute oder auch das Göttliche, das in den Werken schöner Kunst zuerst und auf dieser Stufe als das sinnlich erfahrbare Göttliche in Erscheinung tritt. Diese Hegelsche Positionierung der Kunst innerhalb seiner Philosophie des absoluten Geistes bedingt nicht nur ihren einmaligen Höhepunkt in der klassischen Kunst des griechischen Altertums, sondern zugleich (...) mit diesem auch die Sicht der Kunst als einer solchen, deren Zenit ein Vergangenes ist. Muß hieraus aber mit Notwendigkeit die Sinnlosigkeit weiterer Kunstausübung folgen? Im Zuge einer Darstellung der wichtigsten Begriffe und Theorien innerhalb der Hegelschen Vorlesungen über die Ästhetik geht vorliegende Studie auf derartige Fragestellungen ein. Ein zweiter Hauptteil befaßt sich ausführlicher mit der Musikästhetik Hegels. Der Autor widmet sich hier den Antworten Hegels auf Fragen nach Material und Anschauungsform musikalischer Kunst und deren qualitativen wie auch quantitativen Bestimmungen. Zudem wird die Hegelsche Bestimmung des Wesens musikalischer Kunst als kadenzierte Interjektion erörtert. Zur Einleitung in den Themenbereich der Arbeit werden in knapper Form die musikästhetischen Aussagen Kants in dessen Kritik der Urteilskraft referiert. (shrink)

Die vorliegende Arbeit besteht, von Beigaben wie Indizes und Bibliographie abgesehen, aus einer 124 Seiten umfassenden Einleitung und einer 328 Seiten umfassenden vollständigen Werkausgabe des bisher wenig bekannten Antipalamiten Theodoros Dexios. Seine Schriften, eine von POLEMIS (P.) als „Appellatio“ bezeichnete Beschwerde über die Voreingenommenheit des Ioannes Kantakuzenos auf dem Konzil von 1351, zwei Briefe und ein von P. so genannter „Tractatus brevis de Christo ipso splendente in Transfiguratione“ sind anonym überliefert, zudem auch ohne Überschriften. Zu Beginn der Einleitung wird G. (...) MERCATIs Annahme, daß die Schriften von Dexios verfaßt wurden, gegen J. MEYENDORFF, der sie dem Arsenios von Tyros zuwies, überzeugend verteidigt. Der Autor des 1. Briefes vertrat die merkwürdige Meinung, daß das Thaborlicht mit dem menschlichen Körper Christi identisch gewesen sei (XVI). Diese Ansicht kritisierte Isaak Argyros in seinem Brief an Gedeon unter Namensnennung des Dexios, wie Mercati bereits feststellte (XXIII f.). Daß die genannten Schriften, die teils in Vat. Gr. 1111, teils in Vat. Gr. 1823 überliefert sind (XIII), auf denselben Autor zurückgehen, ist daraus zu erschließen, daß der Schreiber von Vat. Gr. 1823 in Vat. Gr. 1111 Autorenkorrekturen vornahm (XV f.). Ein wichtiger Punkt der Widerlegung Meyendorffs besteht auch darin, daß dieser die Worte des Dexios, die sich auf den Schluß des vom „seligen Gregoras“ inspirierten Glaubensbekenntnisses der Antipalamiten im Jahr 1351 beziehen, nämlich „an letzter Stelle war in ihm (dem Bekenntnis) folgendes zu lesen: ‚Hinsichtlich des Kalabrers Barlaam und des Akindynos sagen wir, daß wir damit einverstanden sind, was die heilige Kirche Gottes entschieden und festgelegt hat‘ (220), indem wir auf unseren Patriarchen verwiesen“, auf Ignatios von Antiochien, den Vorgesetzten des Arsenios, bezog, dieser schmähliche, wenn auch wohl postume Verrat an Akindynos (so unsere Meinung) aber laut P. eine Anerkennung des Tomos von 1341 bedeutet, mit dem Patriarchen demnach Kalekas gemeint ist (XX f.). P. weist nach, daß der Brief des Dexios, auf den sich Argyros in seinem Brief an Gedeon bezieht, trotz gleicher Thematik nicht mit dem von ihm herausgegeben Brief I identisch ist, sondern etwas früher (XXVI versehentlich „later“) geschrieben wurde (XXVI–XXVIII). Die Datierung der „Appellatio“ auf die Zeit zwischen 1351 und 1354 (Sturz des Kantakuzenos) ist sicherlich richtig. Da Gregoras in seinen zweiten „Antirrhetikoi“ wie Dexios von der Nichtveröffentlichung des Tomos von 1351, der Unvollständigkeit der erworbenen Abschrift wie auch von der Gefahr spricht, durch den Herrscher ermordet zu werden (s. JÖB 36, 1986, 263 f. 276), ist laut meiner Datierung (s. JÖB 27, 1978, 146, Nr. 70) 1353 als wahrscheinliches Datum der Abfassung anzusehen. P. verfaßte eine bemerkenswerte Anmerkung zu Georgios von Pelagonia (XXXI f., A. 65). Die Identifizierung des Georgios Gabrielopulos mit Georgios, dem Philosophen, geht auf R.-J. LOENERTZ und F. TINNEFELD zurück, die mögliche Identifizierung des Georgios von Pelagonia mit Gabrielopulos auf mich (s. PLP II, Nr. 3433 und Talbot in ODB II 838 f., die PLP ausschreibt). Inzwischen bin ich zu dem Schluß gekommen, daß Georgios von Pelagonia, der an Akindynos Kritik übt, auf Grund seiner guten Informiertheit kein anderer sein kann als Akindynos, der wegen seiner Voreingenommenheit gegen Barlaam im Jahr 1341 Selbstkritik übt. Akindynos stammte aus der Region von Pelagonia. Möglicherweise ist er nach seiner Flucht aus Konstantinopel 1347 mit Hilfe Stefan Dušans sogar Bischof von Pelagonia geworden. (shrink)

Constantine the African's significance as the first important translator of medical texts from Arabic into Latin is indisputable due to the fact that his work contributed decisively to the enlargement of medical knowledge in the Latin West. Among his considerable œuvre the translation of al-Maˇgūsī's Kitāb al-Malakī under its Latin title Pantegni, the first real medical compendium in Latin, holds a particularly important position because of its popularity. The Pantegni is divided into the two parts Theory and Practice with ten (...) books each. Yet while the Theorica Pantegni corresponds basically to the Theory in the Kitāb al-Malakī, this is only partly the case for the Practica Pantegni. The content of the differing parts has been put together mainly from other medical texts. The identification of these other medical texts was the aim of some important researches while the last ten years. The aim of this article is to present the sources of the Pantegni, Practica’s third book and to give some indications on the person who made the compilation who – as it seems – wasn't Constantine the African himself. Malia même figurait — selon l'opinion commune — parmi les centres de second ordre. Climate change mitigation has become a paradigm case both for externalities in general and for the game-theoretic model of the Tragedy of the Commons (ToC) in particular. This situation is worrying, as we have reasons to suspect that some models in the social sciences are apt to be performative to the extent that they can become self-fulfilling prophecies. Framing climate change mitigation as a hardly solvable coordination problem may force us into a worse situation, by changing real-world behaviour to fit (...) our model, rather than the other way around. But while this problem of the performativity of the ToC has been noted in a recent paper in this journal by Matthew Kopec, his proposed strategies for dealing with their self-fulfilling nature fall short of providing an adequate solution. Instead of relying on the idea that modelling assumptions are always strictly speaking false, this paper shows that the problem may be better framed as a problem of underdetermination between competing explanations. Our goal here is to provide a framework for choosing between this set of competing models that allows us to avoid a ‘Russian Roulette’-like situation in which we gamble with existential risk. Debates about the EU show that the holy trinity of absolute, indivisible sovereignty, nationality/citizenship and national identity/loyalty should be replaced by multilayered, pluralist concepts for descriptive, explanatory and normative purposes. Democratic pluralism criticizes replacement‐strategies (of the nation‐state by a European state, citizenship‐rights by human rights, national obligations by European or global ones). It opts for productive complementarity guided by two principles: “proximity and accountability” and “correspondence of powers and democratic say” and for progressive transdomestic shifts. The inclusion of the articles (...) on citizenship in the EC Treaty has, unintendedly, contributed to such a shift though it missed historical chances to develop a more democratic and social EU living up to minimal global obligations. One of the primary concerns in animal research is ensuring the welfare of laboratory animals. Modern views on animal welfare emphasize the role of animal sentience, i.e. the capacity to experience subjective states such as pleasure or suffering, as a central component of welfare. The increasing official recognition of animal sentience has had large effects on laboratory animal research. The Cambridge Declaration on Consciousness (Low et al., University of Cambridge, 2012) marked an official scientific recognition of the presence of sentience (...) in mammals, birds, and cephalopods. Animal sentience has furthermore been recognized in legislation in the European Union, UK, New Zealand and parts of Australia, with discussions underway in other parts of the world to follow suit. In this paper, we analyze this shift towards recognition of sentience in the regulation and practice in the treatment of laboratory animals and its effects on animal welfare and use. (shrink)

Hearing has traditionally been regarded as the second sense--as somehow less rational and less modern than the first sense, sight. Reason and Resonance explodes this myth by reconstructing the process through which the ear came to play a central role in modern culture and rationality. For the past four hundred years, hearing has been understood as involving the sympathetic resonance between the vibrating air and various parts of the inner ear. But the emergence of resonance as the centerpiece of modern (...) aurality also coincides with the triumph of a new type of epistemology in which the absence of resonance is the very condition of thought. Our mind's relationship to the world is said to rest on distance or, as the very synonym for reason suggests, reflection. Reason and Resonance traces the genealogy of this "intimate animosity" between reason and resonance through a series of interrelated case studies involving a varied cast of otologists, philosophers, physiologists, pamphleteers, and music theorists. Among them are the seventeenth-century architect-zoologist Claude Perrault, who refuted Cartesianism in a book on sound and hearing; the Sturm und Drang poet Wilhelm Heinse and his friend the anatomist Samuel Sömmerring, who believed the ventricular fluid to be the interface between the soul and the auditory nerve; the renowned physiologist Johannes Müller, who invented the concept of "sense energies"; and Müller's most important student, Hermann von Helmholtz, author of the magisterial Sensations of Tone. Erlman also discusses key twentieth-century thinkers of aurality, including Ernst Mach; the communications engineer and proponent of the first nonresonant wave theory of hearing, Georg von Békésy; political activist and philosopher Günther Anders; and Martin Heidegger. The contrast between the normative functions of political parties in representative democracies and their empirical working is stark and rapidly increasing. This article starts from a sober, realist account of the empirical state of affairs and from structural problems of democracy and participations – in terms of limits of time, information, qualification and relevant expertise – that have to be acknowledged by any realist–utopian proposal of alternatives beyond the exclusive alternative of ‘thin, realist democracy’ or emphatic ‘strong, participatory, direct, or (...) mass democracy’. We can do better. My search for institutional alternatives looks not for the replacement of political parties but for their relief. Many, not all, of their normative tasks can be shared with other functional networks, associations and organizations. In exploring such a new division of political labour I draw on older debates and designs of associative democracy and on recent discussions to democratize expertise and to expertise democracy in order to address urgent societal problems of high-risk decisions under conditions of extreme complexity, contingency, unpredictability and uncertainty and deep contestedness of our knowledge, problems that turn out to be unmanagable by party politics and representative democracy. This paper addresses what we consider to be the most pressing challenge for the emerging science of consciousness: the measurement problem of consciousness. That is, by what methods can we determine the presence of and properties of consciousness? Most methods are currently developed through evaluation of the presence of consciousness in humans and here we argue that there are particular problems in application of these methods to nonhuman cases—what we call the indicator validity problem and the extrapolation problem. The first (...) is a problem with the application of indicators developed using the differences between conscious and unconscious processing in humans to the identification of other conscious vs. nonconscious organisms or systems. The second is a problem in extrapolating any indicators developed in humans or other organisms to artificial systems. However, while pressing ethical concerns add urgency to the attribution of consciousness and its attendant moral status to nonhuman animals and intelligent machines, we cannot wait for certainty and we advocate the use of a precautionary principle to avoid causing unintentional harm. We also intend that the considerations and limitations discussed in this paper can be used to further analyze and refine the methods of consciousness science with the hope that one day we may be able to solve the measurement problem of consciousness. Seckendorff's »Teutsche Reden« of 1691 and the outline of his ideas on natural law published with them are a uniquely eloquent testimony of German Baroque culture. Seckendorff was the only 17th century aristocratic practitioner of courtly and political life to publish a number of his speeches in book form during his own lifetime and to supplement them with a theoretical superstructure substantiating his practical convictions. The text is centrally concerned with the connection between civilization and language culture and the dependence (...) of public speaking on the nature of the state. Seckendorff's unfinished outline of natural law betokens the critical engagement with the rise of secular natural law by a genuinely significant theoretician on the essential issues posed by government and administration. In this essay, we discuss Simona Ginsburg and Eva Jablonka’s The Evolution of the Sensitive Soul from an interdisciplinary perspective. Constituting perhaps the longest treatise on the evolution of consciousness, Ginsburg and Jablonka unite their expertise in neuroscience and biology to develop a beautifully Darwinian account of the dawning of subjective experience. Though it would be impossible to cover all its content in a short book review, here we provide a critical evaluation of their two key ideas—the role of Unlimited (...) Associative Learning in the evolution of, and detection of, consciousness and a metaphysical claim about consciousness as a mode of being—in a manner that will hopefully overcome some of the initial resistance of potential readers to tackle a book of this length. The most efficient known method for solving certain computational problems is to construct an iterated map whose fixed points are by design the problem's solution. Although the origins of this idea go back at least to Newton, the clearest expression of its logical basis is an example due to Mermin. A contemporary application in image recovery demonstrates the power of the method.

In the last two decades, there has been a blossoming literature aiming to counter the neglect of plant capacities. In their recent paper, Miguel Segundo-Ortin and Paco Calvo begin by providing an overview of the literature to then question the mistaken assumptions that led to plants being immediately rejected as candidates for sentience. However, it appears that many responses to their arguments are based on the implicit conviction that because animals have far more sophisticated cognition and agency than plants, and (...) that plants should not have the same moral status as animals, plants should not have any moral status. Put in simpler terms: it is not as bad to eat plants than to eat, say, pigs. While there are still uncertainties around comparative moral and policy implications between animals and plants, given a gradualist account of quasi-sentience and partial moral status, both of which we claim are a matter of degree, we may not have to abolish our convictions by declaring that plants have no sentience or moral status at all. Indeed, we can hold two things at the same time: that animals and plants have moral status, but animals have prima facie more moral status than plants. (shrink)

With increasing attention given to wild animal welfare and ethics, it has become common to depict animals in the wild as existing in a state dominated by suffering. This assumption is now taken on board by many and frames much of the current discussion; but needs a more critical assessment, both theoretically and empirically. In this paper, we challenge the primary lines of evidence employed in support of wild animal suffering, to provide an alternative picture in which wild animals may (...) often have lives that are far more positive than is commonly assumed. Nevertheless, while it is useful to have an alternative model to challenge unexamined assumptions, our real emphasis in this paper is the need for the development of effective methods for applying animal welfare science in the wild, including new means of data collection, the ability to determine the extent and scope of welfare challenges and opportunities, and their effects on welfare. Until such methods are developed, discussions of wild animal welfare cannot go beyond trading of intuitions, which as we show here can just as easily go in either direction. (shrink)

Policies dealing with religious diversity in liberal democratic states—as well as the established institutions that enforce those policies—are increasingly under pressure. Politics and political theory are caught in a trap between the fully secularized state and neo-corporate regimes of selective cooperation between states and organized religion. This volume proposes an original, comprehensive, and multidisciplinary approach to problems of governing religious diversity—combining moral and political philosophy, constitutional law, history, sociology, and religious anthropology. Drawing on such diverse scholarship, _Secularism or Democracy?_ proposes (...) an associational governance—a moderately libertarian, flexible variety of democratic institutional pluralism—as the plausible third way to overcome the inherent deficiencies of the predominant models. Since Boorse [Philos Sci 44(4):542–573, 1977] published his paper “Health as a theoretical concept” one of the most lively debates within philosophy of medicine has been on the question of whether health and disease are in some sense ‘objective’ and ‘value-free’ or ‘subjective’ and ‘value-laden’. Due to the apparent ‘failure’ of pure naturalist, constructivist, or normativist accounts, much in the recent literature has appealed to more conciliatory approaches or so-called ‘hybrid accounts’ of health and disease. A recent paper by Matthewson (...) and Griffiths [J Med Philos 42(4):447–466, 2017], however, may bear the seeds for the revival of purely naturalist approach to health and disease. In this paper, I defend their idea of Biological Normativity against recent criticism by Schwartz [J Med Philos Forum Bioethics Philos Med 42(4):485–502, 2017] and hope to help it flower into a revival of naturalist approaches in the philosophy of medicine. This paper introduces and defends an account of model-based science that I dub model pluralism. I argue that despite a growing awareness in the philosophy of science literature of the multiplicity, diversity, and richness of models and modeling practices, more radical conclusions follow from this recognition than have previously been inferred. Going against the tendency within the literature to generalize from single models, I explicate and defend the following two core theses: any successful analysis of models must target sets of (...) models, their multiplicity of functions within science, and their scientific context and history and for almost any aspect x of phenomenon y, scientists require multiple models to achieve scientific goal z. This article introduces and defends the “pathological complexity thesis” as a hypothesis about the evolutionary origins of minimal consciousness, or sentience, that connects the study of animal consciousness closely with work in behavioral ecology and evolutionary biology. I argue that consciousness is an adaptive solution to a design problem that led to the extinction of complex multicellular animal life following the Avalon explosion and that was subsequently solved during the Cambrian explosion. This is the economic trade-off problem of having to (...) deal with a complex body with high degrees of freedom, what I call “pathological complexity.” By modeling the explosion of this computational complexity using the resources of state-based behavioral and life history theory we will be able to provide an evolutionary bottom-up framework to make sense of subjective experience and its function in nature by paying close attention to the ecological lifestyles of different animals. (2001). Problems and prospects of associative democracy: Cohen and Rogers revisited. Critical Review of International Social and Political Philosophy: Vol. 4, Associative Democracy: The Real Third Way, pp. 31-70.

Political philosophy has difficulties to cope with the complexity and variety of state-religions relations. ‘Strict separationism’ is still the preferred option amongst liberals, deliberative and republican democrats, socialist and feminists. In this article, I develop a complex typology based on comparative history and sociology of religions. I summarize my reasons why institutional pluralist models like plural establishment or non-constitutional pluralism are attractive not only for religious minorities but for religiously deeply diverse societies in general. Most attention is paid defending associative (...) democracy, the most flexible and open variety of institutional pluralism, against realist objections that group representation is incompatible with liberal democracy, that it leads to stigmatization and bureaucratization, that it strengthens undemocratic leaders, that it leads to an ossification of the status quo, and, most importantly, that it is inherently divisive undermining social cohesion and political unity. In my refutation of these objections I try to show that it helps to integrate minority religions into liberal democratic policies compatible with reasonable pluralism and to prevent religious and political fundamentalism. The goal of this programmatic paper is to highlight a close connection between the core problem in the philosophy of medicine, i.e. the concept of health, and the core problem of the philosophy of mind, i.e. the concept of consciousness. I show when we look at these phenomena together, taking the evolutionary perspective of modern state-based behavioural and life-history theory used as the teleonomic tool to Darwinize the agent- and subject-side of organisms, we will be in a better position to (...) make sense of them both as natural phenomena. In order to develop a true biological science of consciousness, we have to remove humans from the center of reference and develop a bottom-up comparative study of animal minds, as Donald Griffin intended with his call for a “cognitive ethology.” In this article, I make use of the pathological complexity thesis (Veit 2022a, b, c ) to show that we can firmly ground a comparative study of animal consciousness by drawing on the resources of state-based behavioral life history theory. By comparing the different life histories of gastropods and arthropods, we will be able to make better sense of the possible origins of consciousness and its function for organisms in their natural environments. Animal welfare has a long history of disregard. While in recent decades the study of animal welfare has become a scientific discipline of its own, the difficulty of measuring animal welfare can still be vastly underestimated. There are three primary theories, or perspectives, on animal welfare - biological functioning, natural living and affective state. These come with their own diverse methods of measurement, each providing a limited perspective on an aspect of welfare. This paper describes a perspectival pluralist account of (...) animal welfare, in which all three theoretical perspectives and their multiple measures are necessary to understand this complex phenomenon and provide a full picture of animal welfare. Assimilation, in other words, instead of washing out the memories of Europe, made them more and more intensely real. [This] is not, however, to admit the failure of Americanization. It is not to fear the failure of democracy. It is rather to urge us to an investigation of what Americanism may rightly mean. It is to ask ourselves whether our ideal has been broad or narrow—whether perhaps the time has not come to assert a higher ideal than the “melting pot.”... We act as if we wanted Americanization to take place only on our own terms, and not by the consent of the governed. All our elaborate machinery of settlement and school and union, of social and political naturalization, however, will move with friction just in so far as it neglects to take into account this strong and virile insistence that American shall be what the immigrant will have a hand in making it, and not what a ruling class, descendent of those British stocks which were the first permanent immigrants, decide that America shall be made. Imagine a world where everyone is healthy, intelligent, long living and happy. Intuitively this seems wonderful albeit unrealistic. However, recent scienti c breakthroughs in genetic engineering, namely CRISPR/Cas bring the question into public discourse, how the genetic enhancement of humans should be evaluated morally. In 2001, when preimplantation genetic diagnosis (PGD) and in vitro fertilisation (IVF), enabled parents to select between multiple embryos, Julian Savulescu introduced the principle of procreative bene cence (PPB), stating that parents have the obligations to choose (...) the child that is expected to have the best life. In this paper I argue that accepting the PPB and the consequentialist principle (CP) that two acts with the same consequences are morally on par, commits one to accepting the parental obligation of genetically enhancing one's children. What is it like to be a bat? What is it like to be sick? These two questions are much closer to one another than has hitherto been acknowledged. Indeed, both raise a number of related, albeit very complex, philosophical problems. In recent years, the phenomenology of health and disease has become a major topic in bioethics and the philosophy of medicine, owing much to the work of Havi Carel (2007, 2011, 2018). Surprisingly little attention, however, has been given to (...) the phenomenology of animal health and suffering. We argue that this predicament is due to its inability to take the pluralism of our moral universe, (...) the multi-layeredness of our social reality, the indeterminacy of our normative principles and the complexity of our practical reasoning seriously. To incorporate these properties of the ‘human condition’ we have constructed a complex evaluative framework, balancing moral, ethico-political, prudential and realist criteria. We argue that political philosophy new style is well advised to adopt such a framework and to position itself, as a true ‘art’, between political philosophy old style and the social sciences. Thus political philosophy is better equipped to deal with the big tradeoffs of today, rekindle our utopian hopes and regain political bite. As scientific progress approaches the point where significant human enhancements could become reality, debates arise whether such technologies should be made available. This paper evaluates the widespread concern that human enhancements will inevitably accentuate existing inequality and analyzes whether prohibition is the optimal public policy to avoid this outcome. Beyond these empirical questions, this paper considers whether the inequality objection is a sound argument against the set of enhancements most threatening to equality, i.e., cognitive enhancements. In doing so, I shall (...) argue that cognitive enhancements can be embraced wholeheartedly, for three separate reasons. However, though the inequality objection does not sufficiently support the conclusion that cognitive enhancements should be prohibited, it raises several concerns for optimal policy design that shall be addressed here. For decades Darwinian processes were framed in the form of the Lewontin conditions: reproduction, variation and differential reproductive success were taken to be sufficient and necessary. Since Buss and the work of Maynard Smith and Szathmary biologists were eager to explain the major transitions from individuals to groups forming new individuals subject to Darwinian mechanisms themselves. Explanations that seek to explain the emergence of a new level of selection, however, cannot employ properties that would already have to exist on that (...) level for selection to take place. Recently, Hammerschmidt et al. provided a ‘bottom-up’ experiment corroborating much of the theoretical work Paul Rainey has done since 2003 on how cheats can play an important role in the emergence of new Darwinian individuals on a multicellular level. The aims of this paper are twofold. First, I argue for a conceptual shift in perspective from seeing cheats as a ‘problem’ that needs to be solved for multi-cellularity to evolve to the very ‘key’ for the evolution of multicellularity. Secondly, I illustrate the consequences of this shift for both theoretical and experimental work, arguing for a more prominent role of ecology and the multi-level selection framework within the debate then they currently occupy.
